You must be at least 13 years old (or 16 in the European Union) to use our apps. By using the apps, you confirm that you meet this requirement.
Lumatra grants you a limited, non-exclusive, non-transferable, revocable license to use our apps for personal, non-commercial purposes. You agree not to:
You retain full ownership of all content you create and store in our apps (journal entries, photos, notes). By using the app, you grant Lumatra a limited license to store, process, and display your content solely to provide the service to you.
You are solely responsible for the content you create. Lumatra does not monitor user-generated content but reserves the right to remove content that violates these terms.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@lumatra.io if you suspect unauthorized access to your account.
Lumatra is not liable for any loss resulting from unauthorized use of your account when you have failed to keep your credentials secure.
All Lumatra app software, design, branding, and original content are the intellectual property of Lumatra and are protected by applicable copyright, trademark, and other intellectual property laws.
The "Lumatra" name and logo, and "JourneyMemo" name and logo, are trademarks of Lumatra. You may not use them without prior written permission.
Our apps are provided "as is" and "as available" without warranties of any kind, express or implied. Lumatra does not warrant that:
We always strive for reliability, but we cannot guarantee 100% uptime or data accuracy.
To the maximum extent permitted by law, Lumatra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use our apps.
Our total liability to you for any claim arising from these terms shall not exceed the amount you paid to Lumatra in the twelve months preceding the claim.
You may stop using our apps at any time by deleting them from your device. You may also delete your account at any time from within the app settings.
Lumatra reserves the right to suspend or terminate your access to our apps if you violate these Terms of Service, without prior notice and without liability to you.
We may update these Terms from time to time. When material changes are made, we will notify you through the app or by email at least 14 days before the changes take effect. Continued use of our apps after that date constitutes acceptance of the new terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dallas, Texas.
